Provider agrees to provide Photo Service during the Service Times set forth above. Provider agrees to provide a minimum of one attendant during the Service Times. Occasionally, operations may need to be temporarily interrupted for adjustments (adjusting settings, adjusting lighting, etc). Event location must be accessible for equipment delivery & setup at least one hour before the start time indicated in the Service Times above. Client is responsible for providing parking for attendant, client is responsible for payment of any parking fees.
We accept checks, ACH & wire transfers, PayPal, Square, and credit/debit card payments. There is a 3% processing fee for payments by credit/debit card, PayPal, and Square. If Client wishes to extend Service Times for a time period in excess of the Service Times agreed to in this agreement, Service Times may be extended, subject to Provider’s availability. If additional service is provided all terms and conditions of this Service Agreement shall remain in effect for the extended Service Times and phrase Service Times as used in this Agreement shall mean the original Service Times of the Service Agreement and the extended Service Times. Client is responsible for contacting Provider to get pricing for the additional hours of service. Payment for the additional hours must be received before additional service is provided.
Client will arrange for appropriate space for the Photo Service at Event's venue (7' deep x 8' wide x 7' high).
If necessary, Client is responsible to get clearance and provide access to the venue for Provider and Provider's equipment. Client is responsible for providing power for the Photo Service with an outlet no more than 25 feet away from Photo Service location. It is recommended but not required for Client to obtain High Speed Internet access from the venue. If Internet is not provided by the venue, Provider will use their own Hotspot but can not guarantee a seamless connection as connection quality may vary from venue to venue. If connection is lost, all data will be stored in the queue and will be sent out when connection is reestablished.
If Photo Service is to be set up in an outdoor setting prior arrangements must be made with Provider. Client is responsible for ensuring that Provider’s equipment is under protective covering and on level ground. In the event Client can't or does not provide appropriate cover Photo Service will end if inclement weather occurs. In the event that services end early due to inclement weather during an outdoor event Client will not receive a refund in part or in full.
Any request for a date change must be made in writing at least 30 days in advance of the original event date. Change is subject to Provider’s availability and receipt of a new Rental Agreement. If there is no availability for the alternate date, the deposit shall be non-refundable. Any changes or cancellations occurring less than 30 days prior to the event date shall not be refunded any amounts paid.
Client acknowledges that Client shall be responsible for any damage or loss to Provider's Equipment caused by Client or Client's associates, employees, or guests, or any theft of Provider's Equipment. Provider's Equipment should not be moved without Provider's supervision.
Client agrees to, and understands the following: a) Client shall indemnify and hold harmless Provider from and against any and all liability related to Client's event during or after Client's event. b) Client shall indemnify and hold harmless Provider from and against any claim by any person or entity due to any injury, or damage, or death resulting from the performance of Provider’s services under this agreement or resulting from the presence or use of Provider’s equipment at anytime Provider’s equipment is present onsite.
Client agrees to, and understands the following: photos and GIFs may be shared on social media sites including but not limited to Facebook, Twitter, and Instagram and Client hereby releases, discharges and agrees to save harmless Provider, from any liability that may occur or be produced thereof, including without limitation any claims for libel or invasion of privacy.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then such provision, or portion thereof, shall be deemed separate from the rest of this agreement and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. Client agrees that any dispute between the parties may be resolved via arbitration.
In the event Provider is unable to provide Photo Service for at least 80% of the service period, Client shall be refunded a prorated amount based on the amount of service received. If no service is received by Client due to circumstances out of Providers control, Provider's maximum liability will be the return of all payments received from Client. Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
